Terms and Conditions
1. Acceptance
of Terms
By enrolling in and utilizing the English tutoring
services provided by Pathways English Tutor (hereinafter referred to as
"Pathways"), students and their parents/guardians (hereinafter
referred to as "Client") acknowledge that they have read, understood,
and agree to be bound by these Terms and Conditions, in addition to the Rules
and Regulations. These Terms and Conditions constitute a legally binding
agreement between the Client and Pathways.
2. Services
Provided
Pathways agrees to provide English language
tutoring services as outlined in the chosen program package. These services may
include, but are not limited to, one-on-one tutoring, group sessions, test
preparation, online sessions, homework assistance, and general English
proficiency improvement. The specific details of the services will be
communicated at the time of enrollment.
3. Client
Responsibilities
The Client agrees to:
a)
Provide
accurate and complete information during the enrollment process.
b)
Ensure
the student's punctuality and preparedness for all scheduled sessions.
c) Facilitate
a conducive learning environment for online sessions.
d) Communicate
any concerns or issues regarding the tutoring services promptly to Pathways.
e) Adhere
to the payment schedule and policies as outlined in the Fee Structure.
f) Ensure
the student abides by the Code of Conduct and all other rules and regulations.
4. Pathways Responsibilities
Pathways agrees to:
a)
Provide
qualified and experienced English tutors.
b)
Deliver
tutoring services in a professional and effective manner.
c)
Maintain
a safe and respectful learning environment.
d)
Communicate
clearly regarding scheduling, fees, and any changes to services.
e)
Address
client concerns and feedback in a timely and constructive manner.
f) Protect
the confidentiality of student information in accordance with privacy laws.
5.
Intellectual Property
All teaching materials, curriculum, methodologies,
and content provided by Pathways are the intellectual property of Pathways
English Tutor. Students are granted a non-exclusive, non-transferable license
to use these materials solely for their personal educational purposes during
the period of their enrollment. Reproduction, distribution, or commercial use of
these materials without explicit written consent from Pathways is strictly
prohibited.
6. Data
Privacy
Pathways collects and processes personal data of
students and guardians for the purpose of providing tutoring services, managing
enrollment, and communicating relevant information. Pathways is committed to
protecting this data in accordance with applicable data protection laws within
India. By agreeing to these Terms and Conditions, the Client consents to the
collection and processing of their personal data as described in Pathways'
Privacy Policy, which is available upon request.
7. Force
Majeure
Pathways shall not be liable for any failure or
delay in performing its obligations under these Terms and Conditions if such
failure or delay is caused by circumstances beyond its reasonable control,
including but not limited to acts of God, war, terrorism, riots, embargoes,
acts of civil or military authorities, fire, floods, accidents, epidemics,
pandemics, strikes, or shortages of transportation facilities, fuel, energy,
labor, or materials.
8. Governing
Law and Jurisdiction
These Terms and Conditions shall be governed by
and construed in accordance with the laws of India, specifically the laws
applicable in the state of Maharashtra. Any disputes arising out of or in
connection with these Terms and Conditions shall be subject to the exclusive
jurisdiction of the courts in Mumbai, Maharashtra.
9.
Severability
If any provision of these Terms and Conditions is
found to be invalid, illegal, or unenforceable by a court of competent
jurisdiction, such provision shall be severed from the remainder of these Terms
and Conditions, which shall continue in full force and effect.
10. Entire
Agreement
These Terms and Conditions, together with the
Rules and Regulations and any enrollment agreement, constitute the entire
agreement between the Client and Pathways English Tutor regarding the provision
of tutoring services and supersede all prior discussions, negotiations, and
agreements, whether oral or written.
